Health and Safety Code 11834.09 lets the department issue a single license to operate an alcohol or other drug recovery or treatment facility upon receipt of a completed written application, fire clearance, and licensing fee, subject to the department's review and determination that the applicant can comply with the chapter and its regulations. Whenever the department issues that license, it shall concurrently provide written notification of the issuance to the city in which the facility is located. If the facility is located within an unincorporated area, the notice shall instead be provided to the county. Initial licenses for new facilities shall be provisional for one year.

BHIN 24-001's DMC-ODS MAT Policy says members needing or utilizing MAT must be served and cannot be denied treatment services or be required to decrease dosage or be tapered off medications as a condition of entering or remaining in the program. DMC-ODS providers offering MAT shall not deny access to medication or administratively discharge a member who declines counseling services. Providing a member the contact information for a treatment program is insufficient.
